§ 4-1. Definitions.

  • The following words, terms and phrases, when used in this chapter, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:

    Animal control officer means the person designated by the village board to enforce the provisions of this chapter. If no village animal control officer is designated, county officials are authorized to enforce the provisions of this chapter.

    At large means to be off the premises of the owner and not under the control of some person either by leash or otherwise, but a dog within an automobile of its owner or in an automobile of any other person with the consent of the dog's owner shall be deemed to be upon the owner's premises.

    Cat means any feline, regardless of age or sex.

    Dog means any canine, regardless of age or sex.

    Neutered, in describing a dog or cat, means a dog or cat having nonfunctional generative organs.

    Owner means any person owning, harboring or keeping a dog. The occupant of any premises on which a dog remains or to which it customarily returns daily for a period of ten days is presumed to be harboring or keeping the dog within the meaning of this definition.

    Pit bull dog means any dog that substantially conforms to the standards set by the American Kennel Club for American Staffordshire terriers or Staffordshire bull terriers or to the standards set by the United Kennel Club for American pit bull terriers.

    Wolf-dog hybrid means any offspring resulting from the breeding of a wolf and a dog, or from the breeding of a wolf and a wolf-dog hybrid, or from the breeding of a wolf-dog hybrid and wolf-dog hybrid.

    Vicious or dangerous animal means any animal:

    (1)

    When unprovoked, attacks, bites or injures a human being, pet, companion animal or livestock on either public or private property or any animal that has a history, known to the owner thereof, of attacking, without provocation; or

    (2)

    Trained or used for fighting against another animal.
